I started life out as auditor for the prestigious auditing firm of Price Waterhouse. I also grew up New Jersey at at time every mayor of a every major city was at some point prosecuted for corruption.

So while I hope every state has a voting process that provides fair access and has the necessary internal controls to insure election integrity, I do not think that it can be fixed by Federal legislation because the situation on the ground is not the same everywhere.

While Americans are mostly focused at the potential abuses that occur at the national level, the vast majority of election integrity issues relate to critical local elections something the Federal government is not particularly concerned with.

What happens when we don’t have tight controls? Answer: We head to the courts…

The same party that attacked Trump for not accepting certified election results is challenging… you guessed it… certified election results…

So while a piece of legislation may have a great sounding name… like the Civil Rights and Voting Rights Act, the issue is not the name, it is not the answer.

Given the fact that politicians can influence (read as “corrupt”) any process and I have little trust in politicians at the Federal or State level to devise a system free from tampering risk. We need a better answer…

So if we really want free and honest elections… first, we need to charge the courts to be empowered and to use their powers to oversee and act quickly to legal challenges regarding access to voting prior to elections and tampering with voting during elections.

We may have to move our elections forward by a month to provide courts more time to examine legal challenges and equip courts with more tools to make determinations regarding election rules, procedures, and outcomes. The Courts should have two mandates…

  1. People who had the right to vote, had a reasonable opportunity to vote
  2. The election results reflect the actual votes cast by voters eligible to vote

What really sets our country apart from other nations is not elections… even China and Russia hold elections… but a Court system independent enough to insure the election was fair and the outcome properly tallied.
